Member terms

These are the terms for joining CLUB. They're short on purpose. Please read them — by joining, you're agreeing to them.

1. Who you're dealing with

CLUB is run by Ta Very Much Ltd, company number 15580316, of 313 Crookesmoor Rd, S10 1BD. In these terms, "we", "us" and "our" mean Ta Very Much Ltd, and "you" means you, the member.

We use a service called Flub to run the club — the pass that sits in your phone's wallet, the messages we send you, and the record of what you've claimed. Flub provides that software to us. Flub doesn't run the club, doesn't set the offers, and isn't who you're contracting with. That's us.

2. What membership is

Membership lets you collect and claim the offers we choose to make available to members of CLUB. It isn't a contract for us to supply any particular product, at any particular time, at any particular price.

Membership is personal to you. You can't transfer it, sell it, or let someone else use your pass.

3. Joining, and your pass

You need to be 16 or over to join. Some offers may have their own age limit — anything involving alcohol is 18+, and we'll ask for ID where we'd normally ask for it.

When you join we'll issue you a membership pass. Keep it to yourself — anyone holding your pass can claim your offers, and we can't tell the difference.

Please give us accurate details, and keep them up to date from your pass so we can keep reaching you.

4. Offers and rewards

  • Offers are available while we're offering them. We can add, change or withdraw any offer, usually without notice — the same way any menu or pricing changes. What we won't do is withdraw an offer you've already unlocked and are entitled to claim.
  • Offers have no cash value, and we can't exchange them for money.
  • Offers are for your personal use, one per member per visit, unless the offer says otherwise. They can't be combined with other offers unless we say so.
  • An offer may depend on availability, on the item being on sale that day, or on a minimum spend. Where that's the case, we'll say so on the offer itself.
  • Our staff apply these terms in the venue, and may decline a claim that looks duplicated, automated, or made with someone else's pass.

5. If your membership is a paid one

Some memberships are free and some are paid. If yours is paid, the price and how often you pay it are shown when you join, and this section applies to you. If yours is free, it doesn't.

  • Renewal. Your membership renews automatically each period until you cancel, taken from the payment method you gave us.
  • Cancelling. You can cancel at any time from your pass. That stops the next payment. Your membership, and your offers, run to the end of the period you've already paid for and then stop.
  • Changing your mind. If you're a consumer, you have 14 days from joining to cancel and get your money back, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you've already claimed an offer in that time, you've asked us to start early and we may keep a proportionate amount for what you've used.
  • Price changes. We'll tell you at least 30 days before a price change takes effect, and you can cancel before then if you'd rather not pay it.
  • Changes to what you get. If we significantly reduce what your membership includes, we'll tell you at least 30 days beforehand, and you can cancel and get back the unused part of what you've paid.
  • Failed payments. We'll try again and let you know. If it keeps failing, we may pause or end your membership.
  • Payments are handled by Stripe. We never see or store your full card details.

6. Messages we'll send you

We'll send you messages about your membership — your pass, your account, and if you pay, your receipts. Those aren't marketing, and they can't be turned off while you're a member.

We'll also send you offers and news, by email and, if we have your mobile number and you've agreed to it, by text. You can stop those at any time using the unsubscribe link in any marketing email we send you — that stops the emails and the texts together. Or email us at ben@pigeon.coffee and we'll do it for you. Our privacy policy explains this in more detail.

7. Using the club fairly

Please don't:

  • use someone else's pass, or let someone else use yours;
  • create more than one membership for yourself;
  • use software, scripts or any automated means to claim offers;
  • misrepresent who you are in order to qualify for an offer.

If you do, we may withdraw the offer, remove you from the club, or both.

8. Ending your membership

You can leave at any time. Email us at ben@pigeon.coffee and we'll remove you. If you pay for your membership, section 5 covers what happens to the period you've already paid for.

We may remove you if you break these terms, if we reasonably suspect fraud, or if we close the club. We'll tell you if we do. If we end a paid membership and you haven't broken these terms, we'll refund the unused part of what you've paid.

If the club closes, your pass and any unclaimed offers stop working.

9. Changes to these terms

We may change these terms — if the law changes, for example, or if how the club works changes. If a change materially affects you we'll tell you at least 30 days beforehand, and if you pay for your membership you can cancel before it takes effect. Minor changes take effect when we publish them here.

10. If something goes wrong

If you're unhappy with anything, please tell us first at ben@pigeon.coffee — most things are quickest to fix that way.

Nothing in these terms limits your legal rights as a consumer, and nothing here excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be excluded by law.

Beyond that: membership is a loyalty scheme, not a guarantee of supply, and we're not liable for indirect or consequential losses, or for an offer being unavailable. Where we are liable and you pay for your membership, our liability is limited to what you've paid us for membership in the 12 months before the problem arose.

We're not responsible for your phone, your wallet app, or your network. If your pass stops working for a reason on that side, ask us and we'll reissue it.

11. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you can also bring proceedings in your own courts.
